GOFF, Circuit Judge.

In August, 1894, the defendant in error instituted an action of ejectment in the circuit court of the United States for the Western district of Virginia against the plaintiffs in error and sundry other defendants,—73 in number,—which was tried in September, 1899, as to these plaintiffs in error and one Eli Hurley, who severed from the other defendants, the result being a verdict and judgment for the plaintiff below. 98 Fed. 913.
