Appellant, Beverly Enterprises-Arkansas, tice. the instant appeal challenging the circuit court’s order granting appellee Paul Hillier’s motion for voluntary nonsuit and dismissing his complaint without prejudice. In response to Beverly’s appeal, Hillier argues that the appeal should be (1) dismissed because the circuit court’s order was not final for purposes of appeal, or (2) affirmed because Beverly waived the issue by failing to obtain a ruling on its motion to set aside the challenged order.
