This is a petition in error from Dodge county. The action below was for damages caused by deceit in the sale of an eating house, fixtures, and furniture, situated in Eremont, on the line of the Union Pacific railroad.
The alleged deception consisted of false representations as to the amount of profit realized by the sellers from the business of the house during the preceding year, and also as to what the purchasers would realize from the businessin the future.
