Robert E. Mitchell appeals the dismissal of his pro se motion to correct an illegal sentence. In 1988, Mitchell was convicted of aggravated kidnapping, aggravated burglary, rape, and two counts of aggravated sodomy. Because Mitchell had been convicted of three prior felonies, the district court sentenced him as a habitual offender pursuant to K.S.A. 21-4504(b) (Ensley 1988). The district court sentenced Mitchell to serve a term of life imprisonment for the aggravated kidnapping count; a term of 45 years to life in prison for each of the rape…
