On December 5, 2002, the State filed a bill of information charging Derek Vance with second-degree cruelty to a juvenile in violation of La. R.S. 14:93.2.3. At his arraignment on January 14, 2003, he pleaded not guilty. Mr. Vance’s motion to suppress the statement was denied after a hearing on March 26th. A twelve-person jury found him guilty as charged after trial on June 24th. The State filed a multiple bill, and after a hearing on August 19th the defendant was found to be a second felony offender.
