PRITCHARD, Circuit Judge.

This is an action of ejectment brought by the plaintiff in error against the defendant below Thomas Hutchins, in the superior court of Swain county, N. C., on the 16th of October, 1899, to recover of the defendant the possession of two tracts of land of 640 acres each, situate and lying in Swain county. The defendant the Whittier Dumber Company was, by an order of the presiding judge of the superior court of Swain county, permitted to become a party and defend the title to the said two tracts of land as the landlord of the defendant Hutchins.
