An information in the nature of a quo warranto was' filed in the Circuit Court for Volusia county in the name of the State of Florida, on the relation of appellee, upon the refusal of the Attorney-Gfeneral to .institute the proceeding on such relation, for the purpose of testing the right of appellant to hold the office of mayor of the town of Daytona, in this State. The information alleges, among other things, in substance, that appellee and appellant were the only candidates for said office at a regular election of municipal officers, for said town held on the 24th day of July, A.…
