—Appellants asserted ownership of certain money and vendor’s lien notes claimed to have been acquired by them by parol gift causa mortis from their sister, Mrs. Annie Fitts, deceased. They instituted this suit against the appellee to recover personal judgment against him, according as the alleged facts might be proven in their several declarations, either personally for his conversion of the said notes and money, or for their value, against him as heir and devisee receiving property of the estate of his father, Dr. A.
