I dissent from the majority’s decision to affirm the February 23, 1993 order of the Court of Common Pleas of Philadelphia county which denies scholarships to deserving graduates of Philadelphia schools — public, private and parochial. The scholarships are intended by clear and unambiguous terms of the 1977 ordinances of city council and resulting agreements between the City of Philadelphia and University of Pennsylvania. Objectors have standing as third-party beneficiaries and as taxpayers to seek enforcement of the local ordinances which authorize the agreements between the City and trustees…
