OPINION
RESTANI, Judge:
This suit against the principal and surety on certain customs bonds is before the court on the cross-motions for summary judgment of the United States and the surety.
Facts
In the summer of 1980, Haitian American Seashells (HAS) entered conch meat into the United States. The Food and Drug Administration (FDA), following procedures which have not been challenged, issued a Notice of Refusal of Admission on August 29, 1980.
