delivered the opinion of the court.
Plaintiff, on the demurrers of defendant being sustained to the original and first amended declaration, by asking leave to and by filing a first and second amended declaration in legal intendment acknowledged the insufficiency of these declarations, so that whether or not the court erred in its rulings on the two demurrers first interposed, is beside the question here presented for our review, which must be limited to the rulings of the trial court on the demurrers to the amended declaration filed April 24, 1903, and our decision…
