The dispositive questions in this case are (1) whether or not a suit by the Board of Regents of the State University and College System is exempt because of the provisions of T.C.A. § 28-115 1 from the three year statute of limitation set out in T.C.A. § 28-305 2 , to inter alia suits, for damages to property; and (2) whether or not under this record the trial judge was correct in dismissing this suit against two defendants 3 on the further ground that there was no privity of contract between them and the plaintiff.
