Dunham-Bush, Inc., as a materialman, brought an action in the Superior Court of Fulton County against Aetna Casualty & Surety Company on its payment bond and Downtowner of Atlanta, Ine., the owner, T. C. Allen Construction Company, the general contractor, and Penmont Mechanical Contractors, Inc. (formerly Garrett-Montgomery, Inc.), a subcontractor.
