RICHARD C. FREEMAN, District Judge.
This is an action brought pursuant to § 60 of the Bankruptcy Act, 11 U.S.C. § 96, to recover as voidable preferences two payments totaling $11,424.09, which were paid to defendant within four months of bankruptcy. These payments were effected by means of joint checks drawn on the account of Joe N. Guy Co., Inc. and made payable to “Hayes Electric, Inc. [Bankrupt herein] and Noland Company.” On September 9, 1974, the Bankruptcy Judge entered an order ruling in favor of the trustee and defendant appealed.
