Upon stipulation of counsel, the above entitled matters were consolidated for the purpose of hearing and determining the following motions:

1. Motion of defendant Shoshone Business Council for summary judgment and motion to dismiss filed on behalf of Walter J. Hickel, Secretary of the Interior, in Civil ease No. 5401.
