Before the Court are two separate motions for summary judgment. The first, Defendant Merrick Bank Corporation’s (“Merrick”) Motion for Summary Judgment (doc. 183) (“Merrick’s MSJ”), asserts, inter ália¡ that Plaintiff BCC Merchant Solutions, Inc.
