The prisoner, with three others, was in-' dieted in the circuit court for the district of Massachusetts, for murder on the high seas. Plumer was tried and convicted. CLIFFORD, Circuit Justice.

Prior to the filing of the petition in this case, the prisoner had been indicted and convicted, in the circuit court for this district, of the crime of wilful murder upon the high seas, and out of the jurisdiction of any particular state, and having waived and withdrawn the respective motions for new trial and in arrest of judgment, which he filed subsequent to the verdict of the jury, he had been sentenced by the court to suffer the punishment of death, as provided by the act of congress under which the indictment against him was found. 4 Stat. 115.
