Before the court are Peggy Black’s (“Black”) motions to intervene on behalf of an indispensable party and to dismiss for failure to join an indispensable party, both filed August 15, 1996. Plaintiff, Midwest Employers Casualty Company (“Midwest”), filed its opposition brief to Black’s motions on August 29, 1996.
