ROBERTS, Justice.

This appeal involves a personal injury action, stemming from an automobile accident, filed by Daniel Boyce, a passenger in a van owned and driven by co-worker Michael Potter, as the two were traveling to their distant job site. The Superior Court (Somerset County, Kravchuk, J.) entered a summary judgment in favor of Potter based on his affirmative defense of co-employee immunity pursuant to the Workers’ Compensation Act.
