This is an appeal from a judgment of $1,000 entered in the Circuit Court of Cook county April 30, 1910, in favor of appellee, hereinafter called plaintiff, in an action on the case brought to recover damages for personal injuries received February 1, 1904, occasioned by the falling of an elevator, while appellee was in the employ of appellant, hereinafter called defendant, as a laborer. The verdict and judgment were rendered on a second trial, — the first trial resulting in a verdict for $2,500, upon which the court entered…
