MEMORANDUM OPINION
ROBERT F. HERSHNER, Jr., Chief Judge.
J. Coleman Tidwell, Trustee, Plaintiff, filed a complaint on September 10, 1999. Charles Robert Hendricks, Defendant, filed a response on October 12, 1999. A trial was held on August 8, 2000. The Court, having considered the evidence presented and the arguments of counsel, now publishes this memorandum opinion.

Defendant is married to Marilyn McDowell. Defendant and Marilyn McDowell are attorneys. 1 Dwight C. McDowell, Debtor, is the father of Marilyn McDowell. Debtor is Defendant’s father-in-law.
