This is a civil action 1 to recover damages under the theft provision of an automobile insurance policy-issued the plaintiff by the defendant insurer. Trial was held in the Superior Court where a jury returned a verdict for the insurer. Thereafter, the Superior Court denied the plaintiff’s motion for a new trial and he filed this appeal.

While plaintiff has alleged in his brief that the trial justice erred in certain portions of his charge to the jury, the record shows that plaintiff offered no objection whatever to the charge. It is well settled that instructions not objected to become the…
