In the court below the plaintiff recovered judgment against *95both of the defendants. From an order granting the defendant Davidson a new trial, the plaintiff has appealed.

On motion of the appellant this court, in Carr, Ryder & Adams Co. v. Glosser el al., 25 Montana Deports, 149, (68 Pac. 1043), struck from the transcript the notice of intention to move for a new trial, the opinion containing the following language: “The notice is not made part of any bill of exceptions or statement of the case on motion for a new trial, nor is it a constituent part of the…
