OPINION OP THE COURT.

PARKER, J.

This is a proceeding for a writ of prohition against the District Court of Lincoln County and the judge thereof, seeking to restrain them from entertaining jurisdiction of a cause there pending. It appears-that the relators are duly elected, qualified and acting trustees of the town of Las Cruces, N. M. On February 22nd, 1913, in the District Court of Dona Ana County, the grand jury of said court returned into open court a presentment or accusation, charging the said relators with certain delinquencies as such trustees therein specified.
