This is a summary judgment case. The case was instituted by appellees, three mi nor children acting through their natural mother, Mozelle Briggs Eakens as their next friend, against appellant Billy Frank Briggs, their natural father. The parents were divorced on June 26, 1958. The divorce judgment granted Mrs. Eakens the custody of the three minor children, and approved a property settlement entered into by the parties.
