INTRODUCTION

Plaintiff First Technology Capital, Inc., (“Plaintiff’) brings this action against Airborne, Inc. d/b/a Firstflight (“Defendant”), for damages allegedly sustained when Defendant breached a contract to purchase an aircraft from Plaintiff. (Dkt. 1). On April 2, 2014, Plaintiff and Defendant entered into a contract for the sale of a 1999 McDonnell Douglas DC-9-83 aircraft carrying the tail number N973TW and the serial number 53623 (“the Aircraft”).
