Petitioner moves by order to show cause pursuant to RPAPL 713 (10) to be restored to possession after being ejected by respondent’s agents. After a hearing the court finds as follows: Petitioner Almonte was put into possession of the subject premises by the alleged prior occupant of the apartment, a Ms. Medina, in July 1992. Petitioner was ousted before the end of July 1992. Petitioner’s niece testified as to a second ejection which she claimed occurred in September in her presence.
