The issue presented for decision by this court is whether the City of New York may, as it claims, employ self-help in the form of force to evict people from a City-owned building. Plaintiffs are a group of families who have resided continuously at 508 West 168th Street, New York, New York, for a period of time varying between four and nine months. The building in question is owned by the City and had remained vacant and unoccupied for a period of time before plaintiffs moved into the building.
