This was an action commenced in the district court of Marshall county on December 10, 1914, by Ottoe Wilson, a minor of the age of seven years, by O. G. Wilson, his father and next friend, as plaintiff, against James W. Lusk, W. O. Nixon, and W. B. Biddle, receivers of the St. Louis & San Francisco Railway Company, a corporation, as defendants, to recover damages for personal injuries sustained by the said Ottoe Wilson because of the negligence of the said defendants.
