HODGES, Associate Justice.

On October 11, 1907, the appellant, Lumpkin, filed his petition in trespass to try title against the appellee, to recover a certain tract of land therein described, and also asked for the issuance of a writ of sequestration. On December 2d following the appellee answered by a motion to quash the writ of sequestration, a general denial, and limitation of five and ten years. The record shows 'that the case was tried on June 24, 1908, and on the same day the appellee filed an amended answer, in which he pleaded not guilty and disclaimed as to all but a specifically…
