This is a civil action brought in the Circuit Court of the United States for the- District of South Carolina, at Charleston, originally by William W. Ker, a citizen and resident *234of the state of Pennsylvania, against George D. Bryan, a citizen and resident of the state of South Carolina, collector of the port of Charleston. Since the commencement of the action, William W. Ker has died, and Roxana S. Ker, executrix of his last will and testament, has been made party plaintiff.
