Affirming in part and reversing in part.

The parties to this appeal were rival candidates for the office of magistrate in magisterial district No. 3 of Floyd county at the regular November election in-1937, Martin Johnson being the nominee of the Republican party and Willie Hall the nominee of the Democratic party. On tabulation of the returns by the County Board of Election Commissioners, it appeared that Johnson had received 1637 votes and Hall 1534 votes.
