Action for conversion of one car load of wheat of the value of $999.38. Recovery by plaintiff and defendant has appealed. The facts ont of which this controversy arose as far as necessary to state them are .as follows:
On January 13, 1906, plaintiff sold on the floor of the merchants exchange in St. Louis to McReynolds & Company a car load of wheat, then on the track in the city of St. Louis to be delivered at the Southern elevator, East St. Louis, Illinois.
