MEMORANDUM OPINION

TITUS, District Judge.

On or about March 24, 1997, Plaintiff Dat Tan Le (“Le”) was driving a car on the Beltway in Prince George’s County, accompanied by one passenger. Le’s vehicle was struck from behind by a passenger vehicle driven by Keith Blocker (“Blocker”). As a result of the collision, Le’s vehicle was immobilized on the Beltway. 1 Le turned on his hazard lights to indicate that his vehicle could not be operated, and at least one police vehicle arrived and its emergency lights were activated.
