GALLAGHER, Chief Justice.

This suit was instituted in ‘the county court of Coryell county by appellees, J. D. Fegette and wife, against appellant, Coryell county, to recover damages to land owned by them and crops growing thereon, which damages they alleged were proximately caused by the manner in which appellant constructed certain improvements on a road adjacent thereto. They alleged that the damages so caused to their land amounted to the sum of $200 and that the value of their crops so destroyed was the sum of $60.
