This is a motion to dismiss an appeal for the alleged reason that the amount in controversy is less than $250. The record is as follows: A complaint was filed in the District Court of Portland on August 6, 1924, to recover the sum of $260 alleged to have been due plaintiff, as executor, together with interest thereon at 6 per cent from the thirteenth day of April, 1924. The answer was filed on September 19, 1924, which denied any indebtedness except the sum of $29.73, which was tendered together with accrued costs and disbursements.
