delivered the opinion of the court.

January 26, 1916, the Trustees of Schools of Township 38 North, Bange 13, East of the Third Principal Meridian in Cook county, Illinois, filed its petition designated by it “Summary Proceeding under the Statute” against the city of Chicago involving section 16 on account of that section being annexed to the city of Chicago. More than fourteen years afterward the Board of Education of the City of Chicago was made an additional party defendant.
