Ernst & Young, LLP (“E & Y”) moves for declaratory judgment that Theodore Wells, Esq., may represent E & Y in this litigation despite that (1) Mr. Wells left Lowenstein Sandler, PC (“Lowenstein”) in January 2000 to join Paul, Weiss, Rifkind, Wharton and Garrison (“Paul Weiss”); (2) Paul Weiss has for the last two years represented Amy N. Lipton, former Vice President and General Counsel of CUC and former Executive Vice President and Deputy General Counsel of Cendant; and (3) Ms. Lipton has not consented to the simultaneous representation of her and E & Y by Paul…
