This action was begun in the justice court of Tulsa county, by L. W. Simerly against the Missouri, Kansas & Texas Railway Company, for the loss of a cow, alleged to- have been negligently killed on the railroad right of way. 'The suit was for $75, the verdict and judgment was for $100, from which the railroad company appealed to the district court, where upon a retrial Simerly obtained judgment for $50, from which the railroad company appeals to this court for review.
