Plaintiff, B. Elliott (Canada) Ltd. (“Elliott”) has brought this action against defendant John T. Clark & Son of Maryland, Inc. (“Clark”) for damage to cargo allegedly incurred while in the custody of Clark following its discharge from the vessel, CV LIGHTNING.
