The district court granted summary judgment declaring that the Secretary of the United States Department of Labor (“the Secretary”) does not have authority under § 503 of the Rehabilitation Act of 1973 (“the Act”) to enforce an agreement by American Airlines, Inc. (“American”) not to discriminate against persons with disabilities as required by its contract with the government.
