On the 22d day of June, 1877, the defendant Dodge, having previous to that date been appointed by Bernard Reilly, then sheriff of the city and county of Hew York, one of his deputies, procured to be executed and delivered to the sheriff a bond, with one Christian Sauer and John McDermott as sureties, in the penal sum of ten thousand dollars, conditioned for the faithful performance of his duty by said Dodge as deputy sheriff.
