This is an appeal from an order of the circuit court of St. Croix county, denying the petition of the railroad company for the condemnation of certain lands situate at Jewett’s Mills, in said county, for the purpose of procuring gravel for the construction and maintenance of the railroad of said company. The respondent, the owner of - the lands which the company sought to condemn for such purpose, opposed the application, and sets forth at length his reasons for opposing the same.
