By accusation defendant was charged with the offense of misdemeanor in that he did operate a motor vehicle on an interstate highway while under the influence of alcohol. Following the denial of his motion for new trial, defendant appeals. Held:

The substance of the State’s evidence against the defendant was that he was observed behind the wheel of a motor vehicle with the engine running in the median between the north and south bound lanes of “1-85”; his head was hanging out the window; the rear wheels of the vehicle were spinning in reverse in an attempt to get back…
