This is an appeal from a decision of the Appellate Division of the District Court Department, Western District, denying the plaintiffs’ petition to establish a report after judgment had entered for the defendant. We affirm the denial of the petition. The plaintiffs commenced this action in the District Court of Central Berkshire on January 18, 1980. The complaint alleged tortious misrepresentation and bréach of warranty. The defendant moved for judgment on the pleadings, pursuant to Dist. Mun. Cts. R. Civ.
