MEMORANDUM OPINION

A. THOMAS SMALL, Bankruptcy Judge.

This matter is before the Court upon the application of the Debtor, C.F. Simonin’s Sons, Inc., to use cash collateral pledged to secure loans from First Pennsylvania Bank, N.A. A hearing was held in Raleigh, North Carolina on March 3, 1983.

FACTS

C.F. Simonin’s Sons, Inc., is a debtor-in-possession under chapter 11 of the Bankruptcy Code, having filed a voluntary petition on February 18, 1983. The present owners of the Debtor are: Southern of Rocky Mount, Inc., (90%); three brothers, McNair Evans (2V2%), Hervey Evans (2V2%), and Murphy Evans…
