This action is for recovery of judgment and decree of foreclosure on a note and first mortgage, for taxes and water assessments, with interest at 12%, attorney’s fees, costs and disbursements. Answer and cross-complaint was filed by appellant, praying for dismissal of plaintiff's action. Trial was had December 17, 1943, before the court, sitting without a jury.
