This action was commenced in the district court for Lancaster county on November 19, 1936, by a “Petition for a Writ of Prohibition,” in which the State of Nebraska, ex rel. William H. Wright, Attorney General, was plaintiff, and Frederick W. Barney, Justice of the Peace, and William R. Linch and Thomas P. Johnson were defendants. These defendants each separately demurred to the petition, which demurrers were by the trial court overruled.
