JONES, Chief Justice.

This is an appeal by appellant Lubbock Independent School District from an order of *275a district court of Dallas county, overruling a motion to discharge the receiver and vacate the receivership, existing by order of the same district court, in a suit theretofore filed by Walter A. Myrick, Jr., against appellee Lubbock Hotel Company, a domestic corporation. The necessary facts are as follows:
