Appeal by the defendant, the J. B. Colt Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Orange on the 30th day of June, 1904, upon the verdict of a jury for $500, and also from an order entered in said clerk’s office on the 1st day of July, 1904, denying • the defendant’s motion for a new trial made upon the minutes.

Miller, J.:

Gras escaping from a carbide feed generator, purchased by the plaintiff of the defendant, was ignited by a lighted gas jet in the room, causing an explosion from which the plaintiff sustained personal injuries, and he brings this action to recover damages alleging a breach of warranty. The generator was used' by him in his business as a photographer in an apartment occupied by him in the city of Hew York. He testifies that he informed the defendant of the place and manner of the intended use of the machine, and that it warranted it to be safe for the purpose. The plaintiff had used…
